The EB-5 visa program was established by the US Congress in 1990 with an aim to boost the US Economy. It is a direct pathway to US Permanent residence or a Green card. The green card is granted to the EB5 investor, their spouse, and unmarried children below the age of 21.

For instance, if an H-1B Visa professional is laid off, the law requires them to find a new employer within 60 days that sponsors the visa else they have to leave the United States or transfer to another visa. This situation can be particularly challenging for people with families. It could result in loss of academic year or internship opportunities for children.

Whereas a green card holder, is someone who is laid off they start looking for jobs without any pressure of visa-sponsorship or timeframes. Although this may cause some financial hardship, it doesn’t require the professional to leave the US.

No aging out of children

One big advantage of EB-5, apart from the financial aspects and employment, is that it keeps families together. Once a child of an H-1B visa holder turns 21, they are required to get their own visas to live, study, or work in the US. And if they fail to get that visa, they will have to leave.

Sometimes the H-1B visa holder, after spending decades in America, end up leaving because their child is unable to get a visa to work in the States. Upon receiving a green card under the EB5 Visa Program, the age of the child does not matter. They can live and work in the United States like their American counterparts.
