About the Settlement Agreement and Golden Gate Global’s Leadership

As a result of the settlement agreement between United States Citizenship and Immigration Services (USCIS) and Department of Homeland Security (DHS) as defendants, and a set of leading EB-5 regional center plaintiffs including Golden Gate Global, previously designated regional centers can now maintain their designation and ability to allow investors to file their Forms I-526E without delay. The settlement agreement elaborates on the requirement for an EB-5 project to receive a Form I-956F receipt for the Form I-526E, and specifies that if a Form I-956F receipt notice is not issued within ten calendar days of physical delivery of filing, USCIS will accept the lockbox notice along with a copy of at least the first six pages of the filed Form I-956F for the purposes of the “receipt number for the regional center’s Form I-956F”.

This settlement agreement was approved by the U.S. Federal District Court Judge Vince Chhabria in the evening of September 1, 2022.

The approved settlement agreement makes Golden Gate Global one of the first regional centers to facilitate investors file their I-526E petitions immediately. The EB-5 investors that are able to take advantage of filing their I-526E petitions early may be presented with unique benefits under the EB-5 Reform and Integrity Act of 2022 (RIA).

Brooklyn Basin Phase 2 is the first of Golden Gate Global’s new investment opportunities in California. Only 15 minutes from downtown San Francisco, Brooklyn Basin is a new waterfront neighborhood in Oakland, California surrounded by open space and stunning views of San Francisco Bay and the East Bay hills. Brooklyn Basin is a phased, master-planned development comprised of 12 development parcels and additional right-of-way and open space parcels totaling approximately 64 acres of waterfront property bounded by Embarcadero Road and the Oakland Estuary.

The Brooklyn Basin Phase 2 project is located in a TEA (Targeted Employment Area), thereby qualifying those that subscribe eligible for a set-aside visas under the renewed regional center program. The RIA allows concurrent filing of Form I-526E and Form I-485, in effect making a conditional EB-5 visa immediately available for those whose who are already in the United States on another visa and whose country is current (i.e., not backlogged) on the visa bulletin. Since every investor’s situation is unique, we recommend that this matter is discussed with an experienced EB-5 immigration attorney.

The Brooklyn Basin Phase 2 EB-5 project consists of two multifamily developments on parcel G (“Project G”) and parcel H (“Project H”) within the Brooklyn Basin community. The project represents Signature Development Group’s second and third multifamily developments in Brooklyn Basin following the Orion which included 241 apartment units and was completed in August 2019.
